3. Accounts

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or security breach.

4. Subscriptions and Payments

Casestudies, Inc. offers subscription-based Services for business customers. Subscription terms, pricing, and billing details are presented at the time of purchase and govern your use of paid features.

5. User-Generated Content and Rights

Our platform allows users to create, upload, or otherwise submit videos, testimonials, images, case studies, and other materials ("User Content").

a. Ownership and License

You retain ownership of your User Content. However, by submitting or publishing User Content through the Services, you grant Casestudies, Inc. and its customers a license to use, display, and distribute that content as part of the Services.

b. Rights Release

By submitting or publishing User Content, you acknowledge and agree that you have obtained all necessary rights, licenses, and consents from any individuals featured in the content.

c. Responsibility for Content

You are solely responsible for your User Content and for ensuring that you have all necessary rights, permissions, and consents to submit it. You represent and warrant that your User Content does not infringe, misappropriate, or violate any third-party rights or applicable laws.

d. Moderation and Removal

Casestudies, Inc. reserves the right, but not the obligation, to remove or disable access to any User Content that we believe violates these Terms or is otherwise inappropriate or harmful.

6. Intellectual Property

All intellectual property in the Services, including but not limited to the platform, designs, trademarks, software, and all associated content, is owned or licensed by Casestudies. You may not copy, modify, distribute, sell, or reverse engineer any part of the Services without our prior written consent. You may use our platform only for lawful business purposes and in accordance with these Terms.

7. Acceptable Use

You agree not to misuse the Services or use them in any way that violates applicable laws, infringes on third-party rights, or harms other users or our platform. We reserve the right to investigate and take action, including termination of accounts, for any violations of this section.

8. Termination

We may suspend or terminate your access to the Services at any time, without notice, for conduct that we reasonably believe violates these Terms or is otherwise harmful to our interests or other users. Upon termination, the rights and licenses granted to Casestudies, Inc. and its Customers under Section 5 will continue in full force and effect.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Casestudies, Inc. does not warrant that the Services will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Casestudies, Inc. and its affiliates, officers, employees, or agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use or inability to use the Services. Our total aggregate liability for any claim related to the Services shall not exceed the amount you paid to Casestudies, Inc. in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Casestudies, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

12. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in San Francisco County, California, administered by the American Arbitration Association. Each party waives the right to a jury trial.

13. Changes to These Terms

We may update these Terms periodically. If we make significant changes, we will post the updated Terms on our website with a revised "Last Updated" date. Continued use of the Services after such updates constitutes your acceptance of the new Terms.
